So why didn't President Bush make this decision the first time around, rather than be swayed by Rudolph Giuliani's lobbying to go with Bernard Kerik? That choice blew up in his face and may well cost Giuliani his bid to garner the Republican Party's presidential nomination in 2008. The fact that Chertoff was the architect of the Patriot Act may give Senator Kerry yet another opportunity (during the confirmation hearings) to betray his penchant for talking out of both sides of his mouth.
